1. Introduction
1.1. These Terms set out the rights and obligations between Rivillo, s.r.o. (“Seller”, “we”, “our”) and any natural or legal person purchasing digital products through our Website (“Customer”, “you”, “your”).
1.2. By purchasing our products, you agree to these Terms. If you do not agree, you must not purchase or use our products.
1.3. Our products are digital products, including but not limited to e-books, printable coloring pages, activity sheets, worksheets, audio stories, digital story packs, bundles, downloadable files, and other creative digital content. No physical goods are shipped.
2. Definitions
For the purposes of these Terms:
Digital Product means any downloadable, printable, streamable, or electronically delivered content offered on the Website, including but not limited to e-books, PDF files, coloring pages, worksheets, activity sheets, audio files, story collections, digital bundles, and other creative materials.
Consumer means a natural person purchasing products for purposes outside their trade, business, craft, or profession.
Business Customer means a person or entity purchasing products for business, commercial, professional, educational, or organizational use.
Website means https://naratopia.com.
3. Ordering Process
3.1. Product information, descriptions, file formats, and prices are displayed on the Website. This information is for guidance only and does not constitute a binding offer.
3.2. To place an order, the Customer selects a product, adds it to the cart, and completes the checkout process by providing the required billing information and payment details.
3.3. Before completing the purchase, the Customer has the opportunity to review and correct the order details.
3.4. The purchase is confirmed by an order confirmation email, which constitutes acceptance of the contract.
3.5. Once payment is successfully received, the Customer receives access to the purchased Digital Product, usually by download link, customer account, email, or another electronic delivery method specified during checkout.
4. Pricing and Payment
4.1. All prices are listed in EUR (€), unless stated otherwise on the Website.
4.2. Rivillo, s.r.o. is not a VAT payer, therefore VAT is not charged on purchases.
4.3. Accepted payment methods may include:
- GoPay secure payment gateway;
- credit or debit cards;
- online banking;
- any other payment methods specified during checkout.
4.4. Payment is required in full before access to the Digital Product is granted.
5. Delivery of Digital Products
5.1. After successful payment, the Customer will receive access to the purchased Digital Product by one or more of the following methods:
- download link sent by email;
- access through the Customer’s account on the Website;
- direct download after checkout;
- another electronic delivery method specified on the Website.
5.2. Delivery of Digital Products is usually immediate after successful payment.
5.3. No physical goods will be shipped.
5.4. The Customer is responsible for providing a correct email address and ensuring that they are able to receive emails from the Seller.
5.5. If the Customer does not receive access to the purchased Digital Product after successful payment, the Customer should contact us at support@naratopia.com.
6. Use of Digital Products and License
6.1. When purchasing a Digital Product, the Customer receives a non-exclusive, non-transferable license to use the product for personal, non-commercial use, unless stated otherwise on the product page or agreed in writing.
6.2. The Customer may:
- download and save the purchased Digital Product for personal use;
- print printable products, such as coloring pages, worksheets, or activity sheets, for personal use;
- use the purchased product at home with their own children or family;
- use the product in a classroom or educational setting only if such use is expressly allowed on the product page or by written permission from the Seller.
6.3. The Customer is not permitted to:
- resell, redistribute, share, sublicense, rent, or transfer the Digital Product to third parties;
- upload the Digital Product to other websites, marketplaces, file-sharing platforms, social media groups, cloud folders, or public databases;
- sell printed copies of the Digital Product;
- modify the Digital Product and resell or redistribute it as a new product;
- claim ownership or authorship of the Digital Product or any part of it;
- use the Digital Product for commercial purposes without prior written permission from the Seller;
- use the Digital Product in a way that infringes intellectual property rights or applicable laws.
6.4. All intellectual property rights, including copyrights, illustrations, text, designs, audio recordings, layouts, characters, stories, and other creative elements, remain the property of Rivillo, s.r.o. or its licensors.
6.5. Any unauthorized copying, distribution, resale, or commercial use of the Digital Products may result in termination of the Customer’s access and may lead to legal action.
7. Right of Withdrawal and Refund Policy
7.1. Under EU Directive 2011/83/EU and applicable Slovak consumer law, Consumers generally have the right to withdraw from a distance contract within 14 days.
7.2. However, in the case of digital content that is not supplied on a tangible medium, the Consumer loses the right of withdrawal once the delivery of the digital content has begun, provided that:
- the Consumer has given prior express consent to the immediate delivery of the Digital Product; and
- the Consumer has acknowledged that by giving such consent, they lose their right of withdrawal.
7.3. During checkout, the Customer may be required to confirm that they consent to immediate access to the Digital Product and acknowledge that by doing so, they lose their right of withdrawal.
7.4. Due to the nature of Digital Products, refunds are generally not provided once the product has been delivered, downloaded, accessed, or made available to the Customer.
7.5. Refunds may be considered only if:
- the Digital Product was not delivered due to a technical error caused by the Seller;
- the file is technically defective and cannot be opened or used, and the Seller is unable to resolve the issue within 14 days after being notified by the Customer;
- the Customer was charged incorrectly due to a technical or payment processing error.
7.6. Refund requests must be sent to support@naratopia.com and must include proof of purchase, order details, and a clear description of the issue.
7.7. If a refund is approved, it will be processed using the same payment method used for the original purchase, unless otherwise agreed, within 14 days of approval.
8. Technical Requirements
8.1. The Customer is responsible for ensuring that their device, software, and internet connection are suitable for accessing and using the purchased Digital Product.
8.2. Digital Products may be provided in common file formats such as PDF, JPG, PNG, ZIP, MP3, EPUB, or other formats specified on the product page.
8.3. The Seller is not responsible for issues caused by the Customer’s device, outdated software, unsupported file formats, printer settings, email filters, or internet connection.
8.4. For printable products, print quality may vary depending on the Customer’s printer, paper, ink, and print settings.
9. Liability
9.1. To the maximum extent permitted by law, the Seller is not liable for:
- indirect, incidental, or consequential damages;
- loss of data, loss of profits, or business interruption;
- inability to access or use a Digital Product due to the Customer’s technical environment;
- printing errors, color differences, or formatting variations caused by the Customer’s printer, device, or software;
- failures caused by external factors beyond our reasonable control, including payment gateway issues, email delivery problems, hosting outages, or third-party services.
9.2. The Seller’s total liability is limited to the purchase price paid by the Customer for the relevant Digital Product.
9.3. Nothing in these Terms excludes or limits any rights that cannot be excluded or limited under applicable consumer protection laws.
10. Customer Support
10.1. Support for purchased Digital Products is provided via email at support@naratopia.com.
10.2. Support may include help with:
- accessing a purchased Digital Product;
- download issues;
- defective or corrupted files;
- basic questions about file formats.
10.3. Support does not include:
- custom modifications of Digital Products;
- individual design changes;
- printing services;
- technical support for third-party software, devices, printers, or applications.
11. Complaints and Dispute Resolution
11.1. If you have a complaint, please contact us first at support@naratopia.com. We will make reasonable efforts to resolve the issue.
11.2. Consumers may also submit disputes through the European Commission’s Online Dispute Resolution platform available at: https://ec.europa.eu/consumers/odr.
11.3. The Seller is not obliged to and does not voluntarily participate in alternative dispute resolution procedures, unless required by applicable law.
12. Data Protection and Cookies
12.1. We process personal data in accordance with our Privacy Policy available at: https://naratopia.com/privacy-policy.
12.2. By using the Website, you acknowledge that we may use cookies and similar technologies in accordance with our Cookie Policy, where applicable.
13. Governing Law
13.1. These Terms are governed by the laws of the Slovak Republic.
13.2. If you are a Consumer residing in the European Union, you retain the protection granted by mandatory provisions of the consumer protection laws of your country of residence.
13.3. Any disputes shall be resolved by the competent courts of the Slovak Republic, unless mandatory consumer protection laws provide otherwise.
14. Final Provisions
14.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.2. We reserve the right to amend these Terms at any time. The version effective at the time of purchase will apply to that transaction.
14.3. These Terms are available on the Website and may be saved or printed by the Customer.
